Top 15 HR Mistakes Employers Make

- Using 1099 independent contractors that should be classified as W-2 employees
- Poor hiring practices: no job description, hiring too quickly, not conducting reference and background checks, hiring friends and family
- Poor new hire documentation: employment applications asking for DOB, SSN, or salary history; no offer of employment letters; or missing benefits, hours, and job descriptions
- Misclassifying hourly employees as salaried; administrative employees are not exempt unless making decisions on matters of significance
- Not E-Verifying employees within 3 days of hire and misfiling Form I-9’s in personnel file instead of keeping separate
- Failure to review employee performance prior to the end of the introductory period
- Neglecting to post all required labor law notices; they should be checked several times a year; need to email copies of posters to remote employees
- Not having current written job descriptions
- Having an outdated or no Employee Handbook
- Failing to train supervisors and managers on HR laws, policies, and procedures
- Not documenting performance and misconduct, and failing to review with the employee
- Failing to provide Jury Duty pay in Alabama for full-time employees
- Assuming you can always fire anyone at any time for any reason in an at-will employment state (depending on company size, EEOC violations can cause wrongful termination)
- Not asking the employee to resign in lieu of separation (the majority will; this will help keep your Unemployment Compensation tax rate low)
- Bonus: For Government contractors, not posting open jobs on State job board for at least 3 days (exceptions for Executive and senior management positions, positions filled internally, and those lasting less than 3 days).
